A Magistrates court is set to deliver its bail ruling in a case involving a 19-year-old student, Ian Njoroge, who is accused of assaulting a police officer along Kamiti Road.
Njoroge, who was arraigned in court on June 4, is charged with violently robbing the officer of a communication gadget. He appeared before Milimani Principal Magistrate Ben Mark Ekhubi and denied the charges.
The prosecution has opposed Njoroge’s release on bail, stating that the investigating officer has not yet completed recording statements from other officers who are witnesses. The Director of Public Prosecutions (DPP) has requested three additional days to finish taking statements and to file a formal application to deny bail.
However, defense lawyers Duncan Okatch and Soyinka Lempaa have argued that there are no compelling reasons to deny the accused bail. “Just because the officers have not recorded statements does not warrant his detention,” said lawyer Okatch. “He is a student at a university and has a fixed abode. He has parents and was arrested at a home.”
The defense has urged the court to release Njoroge on lenient bail, emphasizing his stable residence and the support of his family.
