The prosecution has asked the court to send Kevin Kang’ethe Kinyanjui to the Industrial area remand prison as they cannot take a risk of the suspect escaping from police custody again.
Kang’ethe, who is wanted in the US for the murder of a woman, was arrested on Tuesday night in Ngong after escaping police custody in Muthaiga station on February 7, 2024.
Appearing before the Milimani law court Magistrate Lucas Onyina, prosecutor Vincent Monda told the court that if granted the request, Kang’ethe will be allowed access to lawyers who are appearing for him and no other lawyer.
Similarly, the court was urged to order that when the lawyers visit him they must he must be accompanied by an investigator in this matter.
“We are ready and willing to prosecute this case as soon as possible,” ODPP said.
Further, the court was told that incase he requires any medical attention it should be done in consultation with the government doctors attached to Industrial area prison.
However, Kang’ethe through his lawyers objected to the application, saying that no charge has been pressed against him, and the proceedings before court are that of extradition.
“If anything happened then it’s Up to the state to put its house in order. If he can’t be detained at Muthaiga police station then there are other many stations in the country,” Kang’ethe’s lawyer submitted.
Kang’ethe was first arrested in Parklands area on January 29, after an order from the US.
The fugitive is alleged to have murdered Margaret Mbitu in Massachusetts on October 31, 2023 by inflicting multiple stabs on her face and neck before leaving her body in a locked automobile in a parking garage at Boston Logan International Airport.
He then flew to Kenya.
