Gatundu South MP Gabriel Gathuka Kagombe, alias G.G. Kagombe, was arraigned in Machakos High Court on Monday, charged with murder under Section 203 as read with Section 204 of the Penal Code.
The charge stems from the alleged murder of David Nduati Wataha on May 17, 2024, at around 4:30 p.m. in the Kimuchu area of Makongeni, Thika West, Kiambu County. Represented by a team of lawyers, Kagombe did not enter a plea during this session.
High Court Judge Francis Olel ordered a mental assessment for Kagombe, to be conducted at Kiambu Level 5 Hospital on Wednesday, June 5.
“The accused should be released on anticipatory bond terms issued in Kiambu HRCC miscellaneous application no 804 of 24,” the judge ruled.
However, the state counsel opposed this, arguing that anticipatory bail is no longer applicable after formal charges are filed. Consequently, the accused will need to apply for new bail/bond terms once formally charged in the High Court at Machakos.
Addressing the issue of jurisdiction, Judge Olel stated that the High Court has authority across the country.
The court scheduled Kagombe’s next appearance for Friday, June 7, at 10:00 a.m. for plea-taking, and ordered that he be remanded at Muthaiga Police Station until then.
