The Director of Public Prosecutions (DPP) has dropped the charges against former Interior Cabinet Secretary Fred Matiang’i and his lawyer Danstan Omari over allegations of conspiracy and publication of false information.
The DPP said in a press statement on Monday that the evidence provided by the Directorate of Criminal Investigations (DCI) was not sufficient to sustain the charges against the two.
The DCI had accused Matiang’i and Omari of jointly conspiring to publish in the media that Matiang’i’s home was invaded by a garrison or battalion of unidentified people from the security apparatus on 8th and 9th February, 2023.
The DCI had recommended that Matiang’i and Omari be charged for conspiracy to commit a felony contrary to section 393 of the Penal Code and publication of false information contrary to section 23 of the Computer and Misuse and Cybercrime Act No. 5 of 2018.
However, the DPP said that after independent and thorough analysis of the evidence and review of the statements of the witnesses, he found that the evidence did not meet the ingredients needed to prove each of the offences as required by law.
The DPP has therefore directed the DCI to close the inquiry file with no further police action.
