The Kenya Human Rights Commission (KHRC) and the Muslim for Human Rights (MUHURI) have filed a petition against Deputy President Rigathi Gachagua over what they term as disparaging remarks against Justice Esther Maina.
In their petition filed at the High Court, the two organisations argued that Gachagua’s actions subjected the judiciary to embarrassment and ridicule.
They are now demanding an apology claiming if the action is not dealt with, there will be a high likelihood of constitutional anarchy where members of the public will lose confidence in the Judiciary.
The human rights organisations want an order given to compel the deputy president to retract and apologise over his statements against Justice Maina within 14 days.
“A declaration that his utterances being unsubstantiated claims of corruption, constitute a threat to the person of justice Maina,” the petition read.
Deputy President Rigathi Gachagua, the Ethics and Anti-Corruption Commission (EACC) and the Attorney General have been named as respondents in the case.
