A Kenya Rural Roads Authority (Kerra) accountant whose Sh21 million dowry account was frozen by the Ethics and Anti-Corruption Commission (EACC) is seeking an order to unfreeze it.
Daniel Munywoki Wambua is asking Lady Justice Easther Maina to set aside the orders she made on August 10 to enable him pay his wife’s dowry.
In a suit filed under a certificate of urgency by lawyers Danstan Omari and Matina Swiga, the accountant accuses the EACC of misrepresenting facts about the dowry account.
In a 54-paragraph affidavit, Wambua says he was supposed to pay the dowry on August 5, but the ceremony was thwarted by the High Court, which froze the account containing Sh21 million.
Omari and Swiga say the money the court froze was contributions from 950 friends of Wambua who gave generously towards the ceremony before the couple tied the knot in a church ceremony.
The lawyers, in a submission to Justice Maina, say the EACC told Maina that Wambua was involved in money laundering, a statement they say is false and totally misleading.
“A constitutional body that is involved in assisting men to fight for women they intend to marry has no business but to be dissolved,” Omari said in court papers.
The lawyer prays that the case will be heard quickly as Wambua wants to fulfil his vow to marry his sweetheart.
Apart from working for Kerra, Omari said Wambua is also an established farmer in Matuu, involved in livestock, vegetable and bee farming.
